Should legal action be necessary, CBA|ABA's highly experienced Legal Department assesses each individual claim based on the probability of a successful action and will make the necessary recommendation. We pride ourselves on having to litigate only 3% of our collection files (compared to an industry average of 15%-25%). Our litigation department can also offer clients an alternative to traditional collection methods. By immediately issuing a claim into the small claim court system and obtaining judgment, CBA|ABA has the capabilities to commence aggressive enforcement actions with the objective of recovering not only the full amount of the claim, but interests and costs. As a preliminary means of enforcing a judgment, we are able to garnish bank accounts and salaries, or register Writs of Seizure and Sale to attach Real Estate and thereby prevent the re-mortgaging or sale of the debtor's property.
